Windows 8 vsync

Hey guys
Run into a frustrating situation with windows 8.
I got my mate a laptop running that OS. runs TF2 beautifully except for one thing, Vsync is forced on and from what I’ve read it’s the fault of the OS.
the said laptop has an nvidia card and an intel dedicated card as well
What we have tried:
Nvidia Driver settings : Vsync Forced off ( If tf2 is open at time of force off the frames go over 60 then back again in 3 seconds)
Intel dedicated card driver settings only had 2 modes for vsync: application controlled and ON so we set to application controlled
Run D3DOverrider with force vsync off
Double checked tf2 had vsync turned off in both menu and console.
There must be a way to fix this up, If anyone hasa fix I would truly appreciate this.
Fullscreen or windowed noborder?

We tried both full screen and windowed noborder.
I managed to fix this just last night by swapping between the 2 trying to get the OS to recognise it as a Dx fullsceen application and editing the config.ini in the nvidia settings to force vsync off specifically for hl2.exe
For whatever reason the machine was trying to use the Intel dedicated card for tf2 and that does not have an option to turn off vsync with the latest drivers. We managed to force tf2 to use the nvidia with vsync off and finally fixed it.
